Your Salaried Employee May Be Entitled To Overtime

The Supreme Court ruled yesterday that a highly compensated employee is entitled to overtime pay.

The Supreme Court held 6-3 in Helix Energy Solutions Group v. Hewitt that a former worker who earned more than $200,000 annually was entitled to overtime pay since he was paid on a daily basis.

Whether receiving at least a certain amount every day can be considered a salary was the deciding factor in the case. In a ruling authored by Justice Kagan, the court found that the employee was not exempt because the defendant corporation was not paying a salary as that term is defined by the FLSA.

The employee argued that because Helix calculated his salary using a daily rate, he should have received retroactive overtime compensation. The Supreme Court agreed.
